Due to the nature of creative and digital services, refunds and cancellations are subject to the following policy:

• Project-Based Services: Once work has commenced on a confirmed project, deposits or advance payments are generally non-refundable. Cancellation terms will be outlined in the individual project agreement.
• Digital Products: All sales of digital products, templates, or downloadable assets are final and non-refundable once the file has been delivered or downloaded, unless the product is materially defective.
• Subscription Services: Where subscription services are offered, cancellation will take effect at the end of the current billing cycle unless otherwise stated.
• Exceptional Circumstances: We may consider refunds on a case-by-case basis where a service was not delivered as agreed. Any such request must be submitted in writing within 7 days of the relevant event.

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India. If you access the Website from outside India, you are responsible for compliance with your local laws.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Website, the parties agree to first attempt to resolve the dispute through good-faith negotiation.

Either party wishing to initiate the dispute resolution process must provide written notice to the other party, clearly describing the nature of the dispute and the desired resolution. The parties will then have 30 calendar days from the date of such notice to attempt to resolve the dispute amicably through direct negotiation.

If the dispute is not resolved through negotiation within 30 days, either party may proceed to arbitration as described in Section 37, or to the competent courts of Kolkata, West Bengal, India, as applicable.

If a dispute is not resolved through negotiation as described in Section 36, the parties agree that the dispute shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended.

The arbitration shall be conducted by a single arbitrator mutually agreed upon by the parties or, failing agreement, appointed in accordance with the applicable rules. The seat of arbitration shall be Kolkata, West Bengal, India, and the language of the proceedings shall be English.

The arbitrator's award shall be final and binding on both parties, and judgment upon the award may be entered in any court of competent jurisdiction. Each party shall bear its own costs unless the arbitrator determines otherwise.

Nothing in this clause shall prevent either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to protect its intellectual property rights or confidential information.

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from the remaining provisions of these Terms and shall not affect their validity and enforceability.
